1. Introduction

These Terms and Conditions are intended to regulate access to and use of the website www.segurancarodoviaria.pt, which is the responsibility of Edições Segurança Rodoviária, Lda. legal person no. 504 770 292, with registered offices at Rua José Escada, Ed. K1 - Loja B, 1600-482 Lisboa, hereinafter referred to as ESR.

Anyone who uses the ESR website is assigned the status of User.

The User must read the Terms and Conditions presented here carefully and attentively, since any use of the Site implies full and unreserved acceptance of them. If you do not agree to these Terms and Conditions, then you must not use the Site.

ESR reserves the right to change, add, update or remove parts of these Terms and Conditions at any time and without prior notice. It is the User's responsibility to check the Terms and Conditions regularly for changes.

 

2. Website copyright

All the contents of the Site are the property of ESR, unless otherwise indicated by a reference to their source, and are protected by Copyright and Related Rights, Industrial Property Rights and the Computer Crime Act.

You may not reproduce, distribute, transmit, transfer, modify or use in any way the contents of the Site without the prior express written permission of ESR.

 

3. Site registration

ESR reserves the right for the User to access the information contained on the Site without the need to register. However, there are specific areas where registration is required in order to access.

In order to place an order or subscribe to the Code Testing service, the User must register on the Site by filling in the fields on the form available in the "Login" area, with true, accurate and complete information.

Users are responsible for updating their registration details.

 

4. Products and services

ESR offers various products for sale in its Online Shop.

ESR also offers a Code Testing service to which the User can subscribe, for a certain payment, and use for 15 or 30 days.

In the respective Online Shop, the Products identified with the price are available for immediate purchase. For Products marked "On request", the Customer must contact ESR to obtain information on their availability, price and delivery conditions, by one of the following means:

Products may have limited stock or be temporarily unavailable.

 

5. Prices

The prices indicated in the Online Shop and in the ESR Code Tests are in euros and include VAT at the legal rate in force.

ESR reserves the right to change the price of any Product or Code Testing service at any time and without prior notice.

 

6. Payment modes

For the purchase of Products and/or Services, ESR offers the following payment methods:

- Credit/Debit Card (Visa e MasterCard);

- ATM.

 

7. Product Acquisition or Testing Service

7.1. Buying products:

To place an order, the User must select one or more products available in the Online Store, adding them to the basket. Once the selection is complete, you must consult the basket, in the top right corner of the page, clicking on "View basket" to proceed with the purchase. Then, you must click on “Make Payment”, choosing the desired payment method (Credit/Debit Card or ATM), and filling in the requested data for shipping and invoicing the order. If payment is made by Credit/Debit Card, it is also necessary to fill in the fields relating to it.

If the User has already provided their data in the "My Account" area, they will not need to fill it in again, except for those that are different or have been infringed.

To finalize the purchase, the User must click on the "Complete payment" button and will have a summary with the details of their order.

After payment confirmation, the order will be processed and sent to the address that the user indicated.

By email, the User will receive confirmation of the order and the link to download the respective invoice. In a second email you will receive the order tracking code and the link so you can track the status of your shipment.

7.1.1. Order delivery:

The order will be delivered to the address that the User indicated during the registration process on the Site or to the alternative address entered during the order process, and according to the schedules of the Transport Company.

The order must be checked upon delivery. If the User notices any damage to it, they must return it immediately to the Transport Company and contact ESR at   geral@segurancarodoviaria.pt or edicoes@segurancarodoviaria.pt .

Orders will only be dispatched once payment has been confirmed and will be processed in order of receipt. Orders placed during weekends and public holidays will only be processed on the following working day.

ESR disclaims any liability for any delay or impossibility of processing the order, namely at the time of delivery, due to error or insufficiency of the data provided by the User.

7.1.2. Service and delivery time:

The delivery service is carried out by an external entity (CTT) to ESR.

For products in stock, the estimated delivery time for orders is 3-5 working days for mainland Portugal and 6-10 working days for Madeira and the Azores, counting from the date of confirmation of payment.

As the delivery service is contracted to an external entity (CTT), ESR cannot, under any circumstances, be held responsible for orders being delivered outside the expected time.

7.1.3. Shipping costs:

The shipping costs set by ESR, taking into account the type of product and region, are as follows:

* General Products - The books in the "Road Safety" Collection; the book "The Highway Code"; the "USB Exam Tests" - All categories; the book "Exam Test" (Categories B/B1); the book "Road Safety Module" (Categories A/A1 and B/B1); the book "The Motorcycle" ; the book "Exam Test" (Categories A/A2); the book "Mechanics"; the book "The CAM Test" (Goods and Passengers) and "CAM Tests on USB" (Goods and Passengers) .

** Training rooms and similar - "Virtual Rooms" - Categories B/B1 and C/D; "Code Room on LED Panel" and all the products that make up the room; "Mechanics Room on LED Panel" and all the products that make up the room; "Signage Posters" ; "Interactive Touch Screen with Video Projector" ; "Chassis" and "Digital Tachograph".

**** If you withdraw from a product that has already been shipped, the shipping costs will be deducted from the refund amount.

If it is not possible to deliver the order to the address indicated due to absence or any other situation for which the User is responsible, the costs of a second shipment will have to be borne by the User.

7.1.4. Cancellation of orders:

7.1.4.1. Requested by the User:                     

Order cancellation can be accepted at the User's request, but only if the order has not yet been processed. If the User wishes to cancel their order, they should contact ESR using one of the following methods: Email addressgeral@segurancarodoviaria.pt or edicoes@segurancarodoviaria.pt ; Telephone contact: +351 217 590 278, stating the details of the order, namely its number.

The deadline for refunding a canceled order is 5 working days.

7.1.4.2. By decision of Edições Segurança Rodoviária:

ESR reserves the right not to process orders when it verifies any irregularity in the personal data provided or observes misconduct on the part of the User.

ESR also reserves the right not to process orders or refunds when it verifies errors in the values and/or characteristics of the products, resulting from facts that are not attributable to it.

7.1.5. Exchanges:

In the event of a mistake in the purchase of a Product that has already been sent, ESR will allow it to be exchanged, provided that the requirements defined for this are met. If the Product to be exchanged does not meet the defined requirements, ESR reserves the right not to accept the exchange and to refuse a refund. The Product will be available for collection at ESR's head office address: Rua José Escada, Edifício K1 - Loja B, 1600-482 Lisboa.

The costs of the second shipment will be borne by the User.

7.2. Purchase of Code Testing Service:

To purchase the Code Testing service, the User must select the desired Testing Category by clicking on "Start Testing". Then click on one of the types of Tests available - Exam Test, Thematic Test or Fixed Test - and 1 test will be made available free of charge, which you can take or not.

Afterwards, by clicking on the "Finish Tests" button, the User will be directed to a page with information on payment and the validity of the service (15 or 30 days).

Once the duration of the service has been selected, the User must click on the "Make payment" button, choosing one of the following methods:

- Credit/debit card: fill in the card and billing details correctly and click on the "Finalize payment" button;

- ATM: fill in the billing details correctly and click on the "Checkout" button. The data - Entity, Reference and Amount - will be generated to make the payment.

If you have already provided your details in the "My Account" area, you do not need to fill them in again, except for those that are different or have been breached.

Once payment has been confirmed, the Code Testing service will be activated and the corresponding invoice will be available in the "My Account" area.

By e-mail, the User will receive confirmation of the activation of the service and the link to download the respective invoice.

 

8. Responsibility

ESR has adequate security levels for the proper performance and operation of the Site, and is not responsible for any suspension or interruption of access that may occur as a result of events for which it is not responsible.

 

9. Privacy and Personal Data Protection

ESR guarantees the confidentiality of all data provided by Users.

The personal data that must be filled in on the order form is essential for ESR to provide the Service. The omission or inaccuracy of the data provided by the User is their sole and exclusive responsibility and may result in ESR refusing to provide the Service.

The User's personal data is processed and stored by computer in accordance with the Personal Data Protection Act, and is intended to be used by ESR within the scope of the contractual and/or commercial relationship with the User.
