Considering the accumulated experience in carrying out periodic inspections resulting from the long period of application of Order no. 5392/99, published in the 2nd series of the Diário da República, of March 16, the technological innovations developed by the automobile industry and the inherent need to update the applicable inspection methods and procedures;
Considering the legislative updates that have taken place at European and national level, which must be applied in an integrated manner, in order to improve the safety conditions of vehicles and their environmental protection;
Considering also the implementation of the requirements set out in Ministerial Order no. 221/2012, of July 20, as amended by Ministerial Order no. 378-E/2013, of December 31, which have standardized and improved the technical conditions of the facilities and equipment of inspection centers;
Considering the provisions of Article 10(2) of Decree-Law no. 144/2012, of July 11, as amended by Decree-Law no. 144/2017, of November 29, which establishes that the tables relating to the classification of deficiencies found in the observations and checks carried out during inspections must be established by decision of the IMT, I. P. Board of Directors;
Considering lastly that these tables must specify the names of the deficiencies found in the vehicles submitted to inspection, in order to allow for uniformity in their classification by vehicle technical inspectors:
The Board of Directors of IMT, I. P., pursuant to Article 6(2)(c) of Decree-Law no. 236/2012, of October 31, as amended and republished by Decree-Law no. 77/2014, of May 14, as amended by Decree-Law no. 83/2015, of May 21, resolves as follows:
In the periodic inspections of the vehicles set out in Annex I of Decree-Law no. 144/2012, of July 11, as amended, the procedures for the observations and checks set out in Annex II of the aforementioned decree-law shall apply, with the classification of deficiencies set out in the tables attached to this resolution.
1 - The observations and checks referred to in the previous paragraph are intended to confirm that all the vehicle's equipment remains in good working order, in accordance with the original approved characteristics, and must be carried out without prejudice to the observation of all the elements or components of each system, accessible without disassembly.
2 - In order to verify important points to be checked, removable elements such as mats, lids, covers, panels or others, designed to be easily removed without the use of tools, may be removed.
3 - At the beginning of the technical inspection of the vehicle, the inspector must identify it, checking that the make, model, chassis number and registration number correspond to those specified in the vehicle's identification documents, and that the use of the vehicle is consistent with its category and classification and, where appropriate, with any licensing for the activity.
4 - Whenever it is found that the chassis number is non-existent or cannot be located, contains signs of alteration or tampering, or does not correspond to the vehicle's identification documents, thus compromising its identification, the vehicle must be rejected, with the inspector interrupting the inspection and noting on the inspection form that the tests and checks corresponding to the inspection were not carried out.
5 - Any anomalies relating to vehicle identification must be duly noted on the inspection form, with the additional notes on the form stating: "It is necessary to regularize the vehicle's identification at a deconcentrated IMT service".
6 - The approval of a previously failed vehicle, for identification reasons and whenever the resolution of this anomaly requires the intervention of the IMT, is conditional on the presentation of a document issued by this Institute that allows its circulation, and the center must keep a copy of the proof on file with the vehicle's inspection file.
7 - In the case of a vehicle with several deficiencies of the same type, at the same points inspected, they must be classified in the immediately higher type of deficiencies, if it can be demonstrated that the combined effect of these deficiencies represents an increased risk to road safety.
8 - The inspection actions to be carried out must be carried out along the vehicle, as the inspector is presented with the organs or systems to be inspected, in the simplest and most direct way possible, with the lower part of the vehicle being checked while it is positioned in the pit.
9 - In case of doubt, the inspector may repeat the evaluation test on the item in question to confirm the data, with the last record remaining valid.
10 - In order to confirm the results of the inspection, particularly with regard to the tests on the braking, steering and suspension systems, the inspector may drive the vehicle inside the respective inspection center, provided that the appropriate safety conditions are ensured.
11 - The equipment used in the inspection must meet the requirements set out in the specific legislation which aims to establish the technical requirements that vehicle technical inspection centers must meet.
12 - If the inspection method indicated is "visual", in addition to observing the items in question, the inspector must, if appropriate, handle them, assess the noise they produce, or use any other suitable means of inspection, without resorting to the use of equipment.
13 - Periodic inspections must confirm that the vehicle conforms to the approved type or to the approved conversion, without prejudice to compliance with any legal retrofitting obligations established by national legislation.
14 - All requirements relating to the technical characteristics of a given component must be considered to have been met if it has an EC, UN/ECE or national type-approval mark and is suitable for the model/variant/version of the vehicle being inspected.
15 - When carrying out inspections, all safety aspects must be taken into account when checking the functionality of the various systems and components, in order to avoid crushing, cuts or eye injuries.
16 - Whenever the conditions of cleanliness hinder observations during the inspection, the vehicle must fail and the inspector must describe on the inspection form why the tests and checks corresponding to the inspection were not carried out due to the lack of cleanliness.
17 - The vehicle should not be inspected when the inspector considers that its condition or that of its load does not allow all the tests and checks to be carried out without putting its physical integrity or that of third parties at risk or causing damage to inspection equipment, installations or the vehicle itself.
18 - If the conditions referred to in the previous point are verified after the inspection has begun, the vehicle must fail for the most serious reason considered in the assessment, with the inspector immediately interrupting the inspection and describing on the inspection form why the tests and checks corresponding to the inspection were not carried out because there are no safe conditions for them to be carried out.
19 - Whenever an inspection reveals a change in the number of kilometers on the odometer (odometer), which means that it has decreased compared to a previous inspection, this fact must be noted on the inspection form with the mention - Mileage with change - and this note must be kept on all subsequent inspections.
20 - In the event that the user justifies the change referred to in the previous paragraph by presenting a document issued by an entity with the authority to do so, this fact must be noted on the inspection form under the heading - Justified change in mileage - and this note must be kept on all subsequent inspections, and the document presented must be filed in the inspection file.
21 - Whenever the inspector considers it relevant to record anomalies, particularly those dependent on visual assessment, such as the number of kilometers, identification of the chassis number, nameplates, or situations of a possibly subjective nature, the inspector may make a digital photographic or video record of such anomalies, attaching these records to the vehicle file.
22 - For the purposes of applying Article 13(1)(c) of Decree-Law no. 144/2012, as amended, a deficiency noted in a previous inspection or re-inspection which has not been corrected in good time is considered a repeat offence.
23 - The recurrence of an uncorrected type 1 deficiency determines its reclassification in a new inspection or re-inspection as a type 2 deficiency and the recurrence of an uncorrected type 2 or 3 deficiency maintains the same classification.
24 - Whenever a deficiency is not provided for in the corresponding annex to this resolution, the inspector must consider the designation of the deficiency of the system or component where the anomaly was detected with the classification that best reflects the importance of the observed deficiency.
25 - The judgment/evaluation of the inspection items is the responsibility of the inspector carrying out the inspection, with the Technical Director making the final decision in case of doubt.
26 - After the inspection and before the vehicle leaves the center, the inspector who carried out the inspection must hand over the respective form, informing the vehicle's presenter of its contents with regard to the deficiencies noted, the result of the inspection, the validity of the inspection form and the conditions/restrictions on circulation to which the vehicle is subject if it fails the inspection.
27 - DGV Orders no. 1/96 of January 16, 5392/99 (2nd series) of March 16 and 6620/97 of June 26 are hereby revoked.
This resolution shall enter into force on November 1, 2020.
